Terms of Service

Last updated: 22 October 2026

This is an English translation provided for convenience. The Czech version is the binding one; if the two differ, the Czech version prevails.

1. Introductory provisions

These terms of service govern the use of the EuMo service for auto repair shops at workshop.eumo.cz (the “Service”), provided by:

DigiTale s.r.o.
registered office at K Boleslavce 398, Přemyšlení, 25066 Zdiby

registered in the Commercial Register kept by the Municipal Court in Prague, section C, file 369310
email: talalayev@outlook.com
phone: +420 777 520 727

(the “Provider”). We provide the Service to businesses — auto repair shops, tyre shops and their organisations (the “Customer”) — for the purposes of their business. Consumer protection provisions therefore do not apply to the relationship.

2. Conclusion of the contract and the account

  1. The contract is concluded when an organisation or workshop is set up in the app after a user account has been registered. Whoever sets up the workshop declares that they are authorised to act on behalf of the Customer.
  2. The Customer is responsible for the accuracy of its company details, for whom it grants access in the app and with which roles, and for the security of its users' sign-in credentials.
  3. We verify the company in the Commercial Register or the register of VAT payers. A manually entered company that cannot be verified may have limited features (e.g. it will not appear in the public directory of workshops) until we verify it.

3. Free trial

An organisation's first workshop may start with a free trial, without entering a payment card. The length of the trial is stated in the price list at registration. When the trial ends it does not turn into a paid subscription automatically: if the Customer does not choose a plan, it can still view the workshop's data but cannot change it. Every further workshop of an organisation requires a paid plan.

4. Prices and payments

  1. Current plans and prices are listed in the price list. Prices are stated exclusive of VAT; we charge VAT in accordance with the applicable regulations.
  2. The subscription is paid in advance, monthly or yearly depending on the chosen plan, by payment card through Stripe, and renews automatically at the end of each period. The Customer finds the invoice for each period in the app.
  3. Add-on services (e.g. SMS credit, the phone assistant) are charged at the price shown in the app when they are ordered.
  4. We announce a change in a plan's price at least 30 days in advance; the new price applies from the following period. A Customer who does not agree with it may cancel the subscription as of the end of the current period.

5. Late payment

If a payment fails, we retry it approximately 3, 7 and 14 days after the due date. Until it is paid, the Customer can view the workshop's data but cannot change it. If the payment still does not arrive after the last attempt, we may restrict or suspend access to the workshop; we lift the restriction once the amount owed is paid.

6. Changing the plan and termination

  1. The plan can be changed at any time in the organisation settings. The subscription can be cancelled at any time with effect from the end of the paid period; no refund is given for the remainder of the period.
  2. The Provider may terminate the contract with 3 months' notice, and with immediate effect if the Customer materially breaches the terms of the Service (e.g. uses it for unlawful activity or endangers its security).
  3. The handling of data after the contract ends is governed by the Data Processing Terms.

7. Online payments from workshop customers

A workshop may allow its customers to pay invoices online. The payments are received directly by the workshop through its own Stripe account (Stripe Connect), under its own agreement with Stripe; the Provider is not a party to the payment. If the workshop's plan sets a platform fee on online payments, the fee is stated in the price list and is not refunded when a payment is refunded.

8. Rules of use

  • The Customer uses the Service in accordance with the law and is responsible for the content it enters into it, including data about its customers and employees.
  • The Customer is responsible for having the necessary legal basis for the text messages and emails it sends to its customers through the Service.
  • It is prohibited to circumvent the Service's security, to load it with automated access beyond normal use, or to make it available to third parties other than the Customer's own users.

9. Availability and support

We operate the Service with professional care and strive for its uninterrupted availability; however, we do not guarantee any specific level of availability. We carry out planned maintenance outside business hours where possible. Support is available by email at talalayev@outlook.com or by post to our registered office, and help articles are at help.eumo.cz.

10. Liability

The Provider is liable for damage caused by a breach of its obligations, in total up to the amount of the prices the Customer paid it in the last 12 months. It is not liable for lost profits, for damage caused by incorrect data entered by the Customer, or for outages of third-party services beyond its control. This limitation does not apply to damage caused intentionally or through gross negligence.

11. Personal data

We process the data the Customer enters into the Service about its customers, employees and job applicants as a processor under the Data Processing Terms, which form part of the contract. We process the data of the Service's users in accordance with the Privacy Policy.

12. Changes to the terms and final provisions

  1. We may change these terms; we announce a change by email at least 30 days in advance. A Customer who does not agree with the change may terminate the contract before it takes effect.
  2. The contract is governed by the law of the Czech Republic. Disputes are decided by the general courts of the Czech Republic.
